Declaration of consent for the transfer of usage rights

The Rights Holder hereby transfers to Hoval, at no charge, the irrevocable right to use images, video recordings and audio recordings of the Subject of the Contract for publicity, illustrative and marketing purposes, with no restrictions on the time frame, place or manner in which this right is exercised. The transfer of usage rights also includes the dissemination of images, video recordings and audio recordings of the Subject of the Contract to third parties (such as newspapers, journals and online channels), as well as any kind of processing of the same for the intended purposes referred to above. On the basis of statutory data protection provisions, the Rights Holder’s consent may be required in cases involving the use of personal data, as outlined below.

The Rights Holder expressly confirms that he/she may dispose of images, video recordings and audio recordings of the Subject of the Contract without any restrictions and that no rights belonging to third parties (such as copyright owned by photographers or filmmakers) are associated with these images, video recordings or audio recordings. Hoval may use the images, video recordings or audio recordings without any restrictions in this context. The Rights Holder shall hold Hoval harmless against any violations of the rights of third parties.

 

The Rights Holder consents to Hoval using his/her personal data, especially his/her name and location, in relation to the Subject of the Contract until such time as he/she revokes this consent in writing.  

 

Any revocation of this consent to use personal data shall continue to apply into the future. The lawfulness of the personal data’s use before consent was revoked shall remain unaffected. The Rights Holder may submit any queries, revocations or claims to additional rights concerning access, erasure, restriction or data portability to Hoval’s data protection officer at dpo@hoval.com. If you have a complaint, you can also contact the regulatory authority responsible for Hoval. The personal data of the Rights Holder shall only be stored for as long as is necessary to fulfil the purposes of doing so and/or for as long as there is a legal basis for doing so.

 

The personal data of the Rights Holder that is collected on the basis of this agreement shall be handled confidentially and shall not be passed on to third parties outside the Hoval Group.

 

Should individual provisions of this agreement become ineffective or unenforceable, this shall have no bearing on the effectiveness of the other provisions. Any ineffective or unenforceable provision shall be replaced by one whose content and economic purpose comes as close as possible to the intended provision.

 

This agreement is subject to Liechtenstein law. The place of jurisdiction for any disputes resulting from this agreement shall be the Fürstliches Landgericht (Principality Court of Justice) in Vaduz, Liechtenstein.
